How Old Do I Have to Be to Adopt?

Domestic adoption qualifications can vary from state to state, as each state has its own laws and regulations. To adopt nationwide, prospective parents must be at least 25 years old or older. Though some states have lower legal age requirements, prospective parents under 25 are limited in their options from where they can adopt.

Is There an Adoption Age Limit?

Aside from a minimum legal age, there aren't many age-related adoption restrictions across the United States. In fact, only a handful of states have determined an upper adoption age limit. While Angel Adoption has no age limit in place at this time, many other adoption agencies set an upper age limit of 50 for various reasons.

Ethical Considerations for Older Prospective Parents:

  • Am I in good health?
  • Will I have the energy to raise a child from newborn through adulthood?
  • Do I reasonably think I'll be able to share in the important moments of my child's life, such as marriage or becoming a parent?
  • Do I hope to be a grandparent, and will I have enough years to enjoy that time as a grandparent?

These are just a few questions for older prospective parents to consider when thinking about starting a family. While important, plenty of older parents in their 40s or 50s do work toward building families of their own, many of which result in successful adoptions.

Do I Have to Complete an Adoption Home Study?

In order to legally adopt, all prospective parents must complete an adoption home study. The home study process is intensive and rigorous, and its goal is to determine whether a family is emotionally, physically, and financially ready to adopt.

Can I Adopt a Baby Without Being Married?

It's not an adoption requirement to be married in order to bring a new baby into your life. At Angel Adoption, we provide services for both single-parent adoptions and married couple adoptions alike. Furthermore, we fully support adoption for heteronormative, non-binary, and LGBTQ+ adoptive parents of all races, religions, and backgrounds.

Can Same-Sex Couples or LGBT Parents Adopt?

Absolutely! There are no adoption restrictions on same-sex couples or LGBT adoptions throughout most of the United States. At Angel Adoption, we believe every adoptive parent deserves equal treatment in the pursuit of building a family, and we fully support all of our prospective parents.

Can I Adopt if I Already Have a Child?

Yes! There are no adoption restrictions preventing current parents from continuing to grow their families. As long as parents are legally approved to adopt after completing their home study, we can help guide them through the process.

Can You Adopt With a Criminal Record?

This is a tricky question, as the answer revolves around meeting certain criteria of the adoption home study, which does include FBI background checks. It's safe to say that having a criminal record can, at best, make it more difficult to adopt a baby, but that doesn't necessarily mean prospective parents are barred for any and all offenses.

What Are The Adoption Financial Requirements?

Any adoption financial requirements are considered part of the home study when prospective parents are assessed on their ability to financially care for and raise a baby. That said, caring for a child can be expensive, and prospective parents should prepare for costs associated with adding a new family member to the home, as well as having an emergency fund to cover unexpected medical, living, or other expenses.
